Terms of Business
Model and Talent Packages

All models and talent are required to sign a model release and confirm that they are the age of majority, or have a parent or guardian sign on their behalf. Models under the age of majority must be accompanied by a parent or legal guardian. No meetings or photography can take place if a parent or guardian is not present.

Payment is to be made either in advance, or on the day of shooting (unless alternate arrangements are made in writing). Payment is accepted by cheque, made out to Benjamin Gitterman Photography, or by bank transfer to our business account. You will receive confirmation of receipt of your payment.

A booking is confirmed when the deposit has been received. Deposits are required for all model and talent packages. If you do not attend the session you book without canceling the session with written notice more than twenty four (24) hours before the date of your shoot, the deposit can not be returned to you.

Cancellations must be given in writing no less than seven (7) working days before the planned date of shooting to avoid penalty. You may cancel a booking within seven (7) days of notice or more, to receive a refund of the deposit and or package price, minus any expenses incurred on your behalf, or any surcharges imposed by my suppliers. If you have to cancel with less than seven (7) days notice, the amount of your refund will be at the discretion of Benjamin Gitterman Photography and dependent on costs incurred on your behalf, up to the time of your cancellation.

No refunds are possible on cancelations of less than 24 hours notice. You may choose to reschedule a shoot at less than 48 hours notice. Additional fees may be required for rescheduling under forty eight (48) hours notice. Additional fees may include items such as payment for a make-up artist who has been booked for your shoot.

Rescheduled or postponed bookings must be made within three (3) months of the original scheduled date. No refund of payment is possible after three (3) months of making your first deposit or payment. You must give written notice within three (3) months of making your original payment if you intend to cancel the booking.

You acknowledge that I am entitled to use any or all the photographs from your session(s) for the purposes of promoting my own work, including online, 3rd party directories, publications, and or any other source. Photographs will not be sold to 3rd parties without agreed compensation to the model. If you supply copies of the photographs from the shoot to model agencies or any other source, it is your responsibility to make the agency aware that I reserve my right to be credited for the photography, and that Benjamin Gitterman Photography reserves all copyrights.

Post production and retouching to any or all the images is done at my discretion. It is uncommon that you will have the opportunity to review the retouched images before the final images or prints are produced. If you would like to review the retouching before the final images or prints are produced, you will need to give written notice on or before the day of your shoot. There will be an additional 20% cost of producing the prints for this. If you are uncertain about photo selection, retouching, or any other aspect of producing the images from your shoot, you should arrange a subsequent meeting to do this.

You will receive an approximate timetable for the retouching and delivery of your images or prints once I have received comments and confirmation from you. All post production will be carried out in a timely matter. Allowances should be made for busy periods in my schedule and postal delivery time.

No refunds are possible after the date of the shoot, or after any 3rd party stylists and or crew have attended a shoot, for any reason. You will be given the opportunity to review your shots, make up and hair during the shoot. In exceptional circumstances, where image files become corrupted and or unusable, or where the image files are unusable because of an error, and where the original files are no longer in existence, you may be offered you an additional session at no cost to you to produce replacement images. No monetary claims, refunds, or additional time will be considered, or for any reason due to acts of God, or circumstances beyond my control, including postal strikes, theft of materials in transit, power disruptions, equipment failure or malfunction, etc.
